End User License Agreement

1. Agreement
This End User License Agreement (“EULA”) governs downloadable and embeddable Apex software: the apex.js snippet, @apex-inc/sdk, the Mobile SDK, Server Events libraries, and @apex-inc/mcp-server (the “Software”), provided by Apex, Inc. It is part of the Terms of Service. If they conflict on license scope, this EULA controls for the Software.
By installing or using the Software, you agree to this EULA. If you do not, do not install it.
2. License
Subject to this EULA and an active Apex account, Apex grants you a non-exclusive, non-transferable, revocable, limited license to install and use the Software on systems you own or control, solely to access the Service for that account.
3. Restrictions
You may not:
- Modify the Software except as the documentation allows (configuration, not a fork you redistribute).
- Reverse engineer the Software except to the extent law forbids that restriction.
- Redistribute, sublicense, lease, or host the Software for third parties as a competing service.
- Use the Software to build a competing product.
- Remove proprietary notices.
- Use the Software without a valid Apex account and keys.
4. Data the Software transmits
The snippet and SDKs send events, identifiers, attribution, experiment assignments, and other Customer Data you configure, as described in the Privacy Policy. You are responsible for notices and consent on properties where you install them.
The MCP server transmits workspace and experiment configuration required to run tools. It does not transmit your source code, file contents, repository metadata, IDE settings, or assistant conversation history.
5. Ownership
The Software is Apex’s intellectual property. This EULA does not transfer ownership. Open-source components are licensed separately; those licenses control for those components. See the NOTICES or license files in each package.
6. Termination
This EULA lasts until terminated. It ends if your Apex account closes, you breach this EULA, or Apex discontinues the Software with 90 days’ notice. On termination, stop using the Software and remove copies you control.
7. Disclaimer and liability
THE SOFTWARE IS PROVIDED “AS IS.” THE DISCLAIMERS, LIABILITY CAP, INDEMNITIES, AND ARBITRATION TERMS IN THE TERMS OF SERVICE APPLY TO THE SOFTWARE.
